World War 2 was not officially initiated until German Nazi’s invaded Poland on September 1, 1939. America did not get Involved in the war until December 7, 1941, Japan bombed Pearl Harbor, war was not declared on Japan until the following day. December 11, 1941 Germany declared war on the united States. Back home In America, they to were taking action to protect their homeland. In February of 1942, President Roosevelt signed an executive order to relocate all Japanese Americans. This occurred because of the bombing of Pearl Harbor, Many feared that the Japanese were attempting to â€Å"Remain loyal to their homeland† and were acting as spies. Even without concrete evidence, President Roosevelt signed for them to be relocated. These camps were still located on American soil and were not death camps. The camps were concentration camps, a place where they go to basically do hard labor all day. Many Japanese American families sold their homes and assets, here was no guarantee that their lives would continue as normal upon their return. Their homes sold for fractions of the price they were actually worth, even Japanese vets of WWW were forced to leave their homes and assets behind. It did not matter If the families were born and raised In America and had never been to Japan, the fear of an invasion was to great to allow a possible security issue be lose. Until the camps were finished the Japanese Americans were held in stables at local racing tracks. Ten camps were completed and the camps were built in remote areas of seven western tastes : Arkansas, California, Wyoming, Colorado, Idaho, and Utah. The housing was poor, Tarpaper Barracks were the housing for the Japanese. There were communal mess halls for family to dine with one another, the children had to attend school and the adu lts had the option to work for 5$ a day. The Japanese definitely were not living high class, but the camps they were located to where heaven to the Jewish In Germany. The plan for the camps was for them to be self sufficient, by farming for food. The solo was not Ideal for this plan however. The homes were not heated or lolled during seasonal changes and the food was made army grub style. The Japanese Americans were not allowed to leave because security would not hesitate to shoot one who tried to escape. There was armed security that stood round clock watch over the Japanese Americans. 27,000 Japanese Americans were wrongfully relocated into concentration camps, when challenged by Fred Sauerkraut, the Supreme Court showed little to no sympathy and said it was war time necessary for the camps. The government and the people without a Japanese bloodline agreed that it was simply for the time of war. When people all over the world know who a company is, what they do, and where they are located, the company gains a unique competitive advantage over the rest of the industry. A good way to analyze this resource is to use the VRINE Model (Strategic Management, 2007). This breaks down in order to analyze its value, rarity, inimitability, and exploitability. For this resource I’ll start by assessing its value. The question that must be answered is, â€Å"does this resource allow the firm to meet market demand or protect the firm from market uncertainties? † (Strategic Management, 2007). In the case of the brand name resource, I believe that it gives them ample protection against uncertainty and enables them to compete, if not lead, in the industry. Exxon operates in over 200 countries around the world (Datamonitor, 2008) The fact that this company is present all over the world, and not many other industry competitors operate in so many different regions, proves that this particular resource is very valuable to the company. If a company can possess something that another company cannot, value is inevitably created for that resource. After analyzing the resource using the VRINE Model, all aspects of the model have been met, so it is safe to say that this resource can give them a competitive advantage among its competitors. Another important resource that Exxon possesses is the presence of human expertise capital throughout the company (Datamoitor, 2008). Exxon employs many scientists and engineers that are researching and finding new ways to gain access to more energy resources and make the new innovations less harmful to the environment (Annual Report, 2007). This human capital has proven to be a very important resource for the company as shown by their development of new ways to increase liquid natural gas supplies and â€Å"enhancing heavy oil recovery† (Annual Report, 2007). I believe it also eliminates some uncertainty because while the company is researching and developing cutting edge technology, it keeps them knowledgeable about all the new innovations and ideas that are throughout the industry. This makes the resource very valuable. Next, the rarity of the resource must be analyzed. I believe that this resource is rare because of the entire department (the Upstream Research Center) within the company devoted to letting these scientists and engineers use their knowledge to propel the company into the future (Annual Report, 2007). Some companies have R D departments, but they don’t posses the funding for such expertise and capabilities within these departments like Exxon has in its Upstream Research Center (Annual Report, 2007). This makes the breadth of their scientists and engineers and rare resource among it competitors. Following the VRINE Model, inimitability is the next aspect to analyze. I believe that it would be very difficult for any company to gain the human expertise capital that Exxon has. Exxon pays particular attention to its scientists and engineers by providing opportunities to use their knowledge to help solve every day problems that the company is facing. Many of these scientists and engineers had PhDs in their respective fields, thus making their ideas more credible and valuable to the company (Annual Report, 2007). This make the human expertise capital an inimitable resource because it makes it hard for other companies to replicate the magnitude of the distinguished human capital that Exxon possesses. The next step in the VRINE Model is nonsubstitutability. It would be nearly impossible for a competing company to substitute an equally effective team of engineers and scientists. The cost would be too great for the company. Exxon is leading the way in Research and Development trends, and substitutes for the quality of employees that Exxon has would be very difficult for other companies, making the nonsubstitutability of Exxon’s human capital very high. The final step is to analyze the exploitability of the human expertise capital. Exxon has proven that the expertise that is present can be exploited to develop new and innovative ideas that help Exxon maintain as an industry leader. One example of the result of this exploitation is the development of Metallyte UBW-ES, which is a new polypropylene film for packaging that has unprecedented sealing power (Datamonitor, 2008). This example proves that the exploitability of this human expertise capital makes this resource a valuable asset to the company. After analysis of the human expertise capital resource using the VRINE Model, it can be said that this resource gives Exxon Mobil a competitive advantage in the industry. Capabilities After assessing the resources that Exxon has available to them, it is now easier to illustrate what Exxon’s capabilities are because of the acquisition and ownership of these resources. One of Exxon’s important capabilities is their extensive research and development capabilities. Exxon’s research and development capabilities are very dynamic in the sense that as new energy conservation and developments arise, they can adapt their research and development departments to meet the new technologies and innovations. Their research and development capabilities go insofar as to â€Å"improve existing products, and enhance service† (Datamonitor, 2008). I am writing you this memo in compliance with the mandatory mediation requirements issued by the court. I would first like to state to you my stance in this case. I have been dealing with this particular vendor for about six months now. The business relationship started after my wife and I visited Mrs. Doe’s Sunday school class in Huntsville, Alabama. I was there in support of my wife and to explore the Christian religion, but in small talk Mrs. Doe informed me of her family’s grape vineyard and the value of a certain natural product they produced. My natural herb store was in need of some new products for my customers so I agreed to try Mrs. Doe’s product in my store. The muscatine products were a success so naturally I continued to place orders for the products by phone and paid the invoices as the money became available; at this point in the business relationship there was no written contracts signed between Mrs. Doe’s business and mine thus my understa nding is that our contract was of the implied variety, meaning that the action of my ordering and her supplying was the contract. After a few months I began hearing chatter about the popularity of muscadine grape products, and as a vendor I needed to get some legal documents locking down my business relationship Mrs. Doe’s vineyards before the price of the supply went too high. When I first started my company 2011, I remember reading a book about the laws of supply and demand. I remember reading that as the rise in demand grew the cost of the supply would grow as well. To refresh my memory I went back over that book and there it was in black and white â€Å"to make money within this cycle, get in early and get out early. That is, increase your supply as the demand starts to rise and cut your price as the demand starts to fall† (Ball K., Seidman. D 2011). Clearly our implied relationship was not going to be enough to keep me on top of this product increase, I knew whatever I was going to do I needed to do it fast. I had remembered that there as going to be a delivery coming from the vineyard that d ay so I typed up a quick contract that would set in place my current pricing and future deliveries as well. The contract was just a formality to  protect myself and my company, sure Mrs. Doe was a good Christian lady, but I was not convinced that Christianity and business had anything to do with one another. When Mrs. Doe’s son arrived with the delivery I asked the young man to sign the contract as, like I stated earlier, a formality for both companies. I had reviewed all aspects of the contract and did not perceive anything within the contract that was already out of our ordinary routine. I would call and place an order, Mrs. Doe would fill the order and deliver it to our establishment then within a month or so I would pay my invoice. Paying the invoice within 30-45 days gave me time to sell some of the product so that it virtually paid for itself. I was not aware of Mrs. Doe’s son’s age and since I was not expecting the business relationship to sour anytime soon, I did not think to ask if he was a legal adult. When I asked Mrs. Doe’s son to sign the contract he did not offer any information about his age either so in my defense what reason would I have to suspect otherwise. Once I learned of the Huffington Post’s article praising the value of muscadines I knew it was a matter of time before Mrs. Doe either opt to raise the price of her products, I never expected her to want to cancel our business transactions indefinite. I was sure by now that her some had disclosed the contract to his mother by now, it was pertaining to the family business and if he was competent enough to make the deliveries and assist his mother with the company then surely he was responsible enough to give her the contact that he had signed. When Mrs. Doe reveled to be that she was no longer going to supply me with the product I was surprised and angered, we had an agreement. Once Mrs. Doe informed me that she had no knowledge of the contract I immediately faxed the contract to her and then began researching my next legal steps. During my research of contract law I discovered a publication that highlighted all the legal aspects of binding legal contracts. There are several reasons that I judge may rule a contract unenforceable, one of which relates to nondisclosure due to lack of capacity, this immediately required more study. According to the publication â€Å"It’s expected that both (or all) parties to a contract have the ability to understand exactly what it is they are agreeing to. If it appears that one side did not have this reasoning capacity, the contract may be held unenforceable against that person. The issue of capacity to contract usually comes up when one side of the agreement is too young or does not have the  mental wherewithal to completely understand the agreement and its implications† (Stim 2000). I knew that Mrs. Doe would try to use her son’s age as a reason not to honor the contract. I personally believe that if Mrs. Doe actually had no knowledge of the contract it was due to her son’s deception thus proving he had full capacity when he signed the contract. I cannot contest to how thi s legal matter will change my thought process about Christianity. I do not see that Mrs. Doe’s attempt to dishonor our contract as an immoral act. When Mrs. Doe first contacted me I was angry and started to see her breach of contract as a flaw in her moral compass but then I read a passage in another publication I had researched. The aurthor stated that â€Å"a tension exists between the felt sense that wrong has been done when contracts are broken and the actual operation of the law† (Porat, A., & Ben-Shahar, O. 2010). I believe that I have to separate this lack of good judgment in Mrs. Doe’s case from my evaluation of God and Christianity, in doing so I must also take full advantage of my legal rights as a business owner. In order for my business not to suffer from this attempt to breach the contract either Mrs. Doe must honor the contract until the end or she must pay me for the damages that would be associated with the vineyard canceling our agreement, anything less would be unacceptable and a I will continue forward with my lawsuit. It would be incorrect to dismiss In fact, it is this respect for fact and for the truth that makes it impossible to dismiss Jocasta as someone who has no respect ofr the gods. Her first reference to the gods is not dismissive far from it. She accepts Creons oath of innocence because it was sworn by all the gods. It is only when she is told that her husbands state of mind is the result of the words of Tiresius that she ecomes dismissive, even contemptuous. In other words, She is not dismissing the god she IS dismissing the idea of oracles, oracles delivered by men, or the idea that an oracle reveals something that is inevitable. And, like the pragmatic woman she is, an oracle that she fully and logically believes was wrong. She is not concerned does not even consider his guilt in the murder of Laius, or about his oracle coming true, only that rampant fancies in a legion raid/the mind of Oedipus. (48) Of greater importance to her, however, than fact and the truth of prophecy Living s she does in an age that accepts the idea of fate, this insistence on fact and the dismissal of oracles might still seem arrogant, but it quickly becomes clear that Jocastas main concern is the happiness of her husband. We need to remember that the main concern of Oedipus is the fact that he might turn out to be the murderer of Laius, and therefore, the cause of the citys agony. She, however, correctly perceives that part of his uncertainty lies in his fear of the oracle that sent him fleeing from Corinth. In her response to his assertion that the verdict tilts to heavily to me (46), he attempts to answer both his fears: Rest assured; his account was that, exactly that, He cannot cancel what he said. The whole town heard, not I alone. And even if he tries to change a word, he still can never make Oh surely, King! the death of Laius tally with the oracle, which said it had to happen through a son of mine poor nbabe, who never killed a thing but himself was killed Oh long before! Her eemingly blasphemous assertion, How dwindled are the grand predictions of Apollo. , (51) and her almost exultant reaction to the news of the death of Polybus This is the man that Oedipus was terrified to kill, so fled;/And now, without the slightest push from him, hes dead. P. 50 have nothing to do with the tribulations of Thebes. They refer only to the Corinthian oracle that she now realizes drove her husband away from parents and a city that he loved. Jocastas concern for Oedipus is all consuming, greater not only than her concern for Thebes, but even greater than her concern for herself. The former is already obvious. The latter becomes clear when the messenger continues his happy story, revealing to Oedipus the truth of his birth. Jocastas response is silent. She goes pale, she covers her face, and she stands, transfixed, now aware that she has fathered are true. She cannot change this. She is guilty of the greatest of sins. Yet she does not rush to kill herself . Instead, she turns to her husband, crying at him to Forget it all. Its not worth knowing. (58) When he persists, so does she: Im pleading for whats best for you. (59) And when it becomes clear that he will not listen and that he will persist in his search for the truth, her response is almost a prayer: God help you, Oedipus! Hide it from you who you are. Her concern again is not for herself. It is all for him. She does not attack oracles anymore. She does not answer questions or react pragmatically. She only urges him to stop the search, thereby trying to spare him the horror that she faces. Shattered in her own soul, her concern is only for his. It is only when she realizes that she cannot stop him that she turns away and rushes to her own death. Jocasta is no simple lover of power, no blasphemer, and no plotter. She is first and foremost a woman to whom love is all. Oedipus falls on a far grander scale, suffering because he attempted to stop the sufferings of an entire city, because he dared to place humankind at a level nearly equal to that of gods. Jocasta falls more domestically, placing the heart above the mind and her husband before herself. His disgrace in the city streets appalls us. But we will not be rulers. Her death upon the marriage bed is closer to our own lives, and should move us even more.

Each organ therefore, should be left to do what is assigned to it under the constitution. If any organ is not performing well it ought to be reminded and its performance monitored by way of accountability. This is not interference but a system of checks and balances in the interest of good government. But separation of powers does not mean insulation of powers because the three organs of the State, particularly the Executive and the Legislature, are at one level or another bound to interact and indeed complement each other in the running of the affairs of the State (World bank, 1992). The executive branch of the government of Zambia is made up of the chief of state president Michael Sata; vice president Guy Scott; the president is both the chief of state and head of government. Cabinet is appointed by the president from among the members of the national assembly. Chief of state includes the name and title of the titular leader of the country who represents the state at official and ceremonial functions but may not be involved with the day to day activities of government. Head of government includes the name and title of the top administrative leader who is designated to manage the day to day activities of government. For example in the UK the monarchy is the chief of state while the prime minister is the head of government. The legislative arm of the government; unicameral National assembly in Zambia is made up of 158 seats, 150 are elected by a popular vote, 8 members are nominated by the president to serve 5year terms (Bratton, 1994). Some of the functions of the legislature include; a)  Impeach the president for gross misconduct, commission of a criminal offence or violation of the constitution; b) Remove the president, cabinet ministers or any other official holding constitutional office such as the Chief Justice, Supreme Court and High Court Judges by a vote of no confidence for incompetence; c) Approve the national budget and make alterations without changing the total figure; d) Scrutinize public expenditure as well as Defense, Constitutional and special expenditure; e) Ratify the declaration of a state of emergency and approve its extension; f) Ratify the country’s foreign policy and international treaties to be entered into on behalf of the country; g) Create public offices; h) Dissolve itself. The judiciary is made up of the court system of Zambia, these include; Supreme Court (final court of appeal; justices area appointed by the president), High Court (has unlimited jurisdiction to hear civil and criminal cases, Magistrate’s court and Lo cal court (ibid). The constitution stipulates a hybrid form of government; a mixture of presidentialism with elements of the Westminster tradition of parliamentary democracy. The current system is, however, closer to the presidential model with delegated powers, and even â€Å"close to the top end of the range of presidential powers† (Burnell 2003: 48). As in other presidential systems the distribution of power between the legislative (parliament) and the executive (the presidency), is unbalanced in favour of the latter. As the 1995 Constitution review commission clearly spelled out: the president is in a position to â€Å"exercise a dominant influence on the legislature†; and â€Å"no sufficient countervailing safeguards are in place to check the executive branch and thus balance the powers† (GRZ 1995: 15, 17). One, if only formal, indication of the weakness of parliament in the Third Republic might be that the average number of bills passed did not exceed that of its predecessors in the First or Second republics. The legislature and even single MPs have various means of controlling the government and initiating legislation. These include the private member bills, Standing Orders, parliamentary questions, the Committee of Supply, the Public Accounts Committee, the Estimates Committee, the Committee on Government Assurances, the Committee on Delegated Legislation, before 1999, seven departmental orientated ‘watch-dog’ committees, as well as the ad-hoc select committees which can consider the ratification of presidential nominations to official appointments such as the attorney-general, Supreme Court judges or the governor of the Bank of Zambia. The problem with all the committees and the provisions for individual MPs to get a hold on the government is that – despite MPs’ lack of special expertise due to shifting membership in committees as well as the lack of support staff it provides â€Å"answerability† without â€Å"enforceability†, which is essential for an â€Å"effective instrument of accountability† (Burnell 2002: 307). The vast MMD majority until 2001 and the ability of government to control and monopolize the legislative timetable made parliament even weaker, although MMD MPs were by no means under the strict control of the party whip or leadership. Since the MMD lost its majority in the 2001 elections and experienced more serious internal factionalism, there are clear indications that the government has to be more responsive to parliament. However, through the powerful position of the Assembly Speaker the ruling party and the government is still largely able to control Assembly p rocedures. A similar context applies to those institutions that are supposed to be instruments of horizontal accountability, such as the Anti-Corruption Commission (ACC), the Office of the Auditor-General, the Commission for Investigations, the Drug Enforcement Commission (DEC), the ECZ and the HRC. These institutions have been proven largely ineffectual, although the courts have sometimes made rulings against the government. Again, there seems to be some improvement since 2001, which, however, seems to be well calculated and directed by the Mwanawasa government at least in the case of the ACC, when the latter was allowed to investigate corruption cases of the Chiluba government. The reason why these institutions are unable to make an impact is because, although legally autonomous, they have very few powers (apart from one exception; the ACC cannot initiate prosecution on its own), and are financially dependent on the government. They are chronically underfunded and despite being presidential appointees, all commission heads do have secure conditions of service. These institutions are therefore highly sensitive to signals coming from the Office of the President, which prompted the MMD’s first Minister for Legal Affairs Rodger Chongwe to refer to them as â€Å"agencies of illusion† GRZ (1999: 104). The Republican Constitution provides for impeachment proceedings against the president for violations of the constitution (Article 37). This provision is difficult to implement and needs a one-third majority in parliament to debate a motion alleging the president has committed â€Å"any violation of the Constitution or any gross misconduct†, while a two-thirds majority is then necessary to start an investigation by a tribunal appointed by the chief justice. If this tribunal finds that â€Å"the particulars of any allegation specified in the motion have been substantiated†, the National Assembly might by a motion of not less than two-thirds resolve that the president has been guilty. Only then shall the president cease to hold office. All attempts to impeach the president have failed in the past. Legally the civil service is non-partisan, but in practice the administration has often been politicized. This is not only a heritage of the old one-party system and a legacy of neopatrimonial rule, but has also been employed deliberately by the new administration. One case in point is Chiluba’s introduction of the post of district administrators (DAs), which are political appointees to direct politics at the district level under his control. The partisan application of the Public Order Act by the police in favour of the ruling party in the run-up to elections is another example. Generally, what has come to be known as ‘rampant’ or ‘endemic’ corruption in the cabinet and other state bodies is only possible with a willing civil service. In an authoritarian political and administrative culture where superiors are not supposed to be challenged and ‘hints’ by superiors are taken as ‘orders’, and in which legal-rational procedures are not regularly adhered to, but irregular (not to say illegal) actions or non-actions are taken as ‘normal’, the civil service cannot be non-partisan but is an instrument of the ruling party. Peter Burnell’s analysis of the endemic â€Å"financial indiscipline† clearly shows that the political and administrative framework for this â€Å"enjoys active connivance from senior government figures and is an entrenched feature of the politico-administrative culture† (Burnell 2001b: 49) in other words: it is deliberately nurtured by the political elite for personal and political gain. At present, local government is not only dysfunctional in its set up but is in many respects derelict.
